The TDS have published it's review for 2009-2010, the contents of which make interesting reading.

The Review shows that the main causes of disputes have remained similar to those experience in previous years with the following consistently being referred to in disputes.

  • Cleaning
  • Damage
  • Redecoration

Cleaning is the single largest issue and is responsible for a staggering 46% of disputes.  The other main dispute issues are damage at 39%, redecoration at 24% and gardening at 12%

The review states "Clearly, the best way to demonstrate that the property has deteriorated over the course of the tenancy is through the submission of a comprehensive Check in and Check out Inventory, supported with an invoice or estimate from a cleaning company.  Despite this, some landlords are still choosing not to present these essential documents when making a claim from the tenant's deposit.

Between 2007 and 2010 56% of disputes were awarded to tenants, 42% landlords and 2% to agents.
